Facing foreclosure in DFW? Sell before the first Tuesday and keep any equity

Yes, you can sell a Dallas–Fort Worth house in foreclosure right up until the sale, and if the price covers the payoff, other liens and closing costs, you keep what's left. Texas sales happen on the first Tuesday of the month after at least 21 days' notice. RESE sends a written cash offer within 24 hours and closes in about 10 days once title is clear, with the title company paying off your loan.

Where you are on the clock

Most Texas lenders can foreclose without a lawsuit, on dates set by Property Code §51.002. The latest letter you’ve received tells you how much room you have.

What you’ve received What it means Room left, at the fastest
Late notices, no certified letter You’re behind. Federal rules generally bar the first foreclosure notice until a loan on your home is more than 120 days late (12 CFR §1024.41(f)). Months
A certified notice of default You get at least 20 days to cure before a sale can be noticed (§51.002(d)). About six weeks from the day it was mailed
A notice of sale, posted at the courthouse and mailed certified The sale is set for a first Tuesday at least 21 days out (§51.002(b)). Until the date on the notice
A home equity loan in default It can be foreclosed only with a court order (Tex. Const. art. XVI, §50(a)(6)(D)). Longer, because a court is involved

Every date, with a worked example, is in The Foreclosure Clock.

How selling first works

  1. You sign a purchase contract, and it goes to a title company.
  2. The title company orders the payoff statement from your servicer and searches for other liens: HOA dues, back taxes, judgments.
  3. At closing, the title company pays off the loan out of the price. What’s left after the payoff, other liens and closing costs is yours.
  4. A paid-off loan leaves nothing to foreclose on, so the sale comes off the calendar. Get written confirmation from the servicer or its foreclosure attorney before sale day.

Aim to close several business days before the sale. If closing gets tight, ask the servicer in writing whether it will postpone. It doesn’t have to say yes.

Your three numbers, with the payoff subtracted

Path When it usually wins With a sale date set
Cash The sale is weeks away, the house needs work, or you need certainty About 10 days to close once title is clear
List No sale is noticed yet, or it’s months away, and the house shows well Needs time for showings and a buyer’s loan
Creative: fix-then-list It needs work and there’s no sale date yet Rarely fits once a sale is noticed, because repairs take weeks

Every column subtracts your loan payoff, so the sheet shows what you’d walk away with. If you owe more than the cash number, the sheet says so, and listing or a short sale may be the better call.

What we can and can’t do

We can put three written numbers in front of you within 24 hours, close the cash path in about 10 days once title is clear, and let you stay up to 30 days after a cash closing on a written leaseback. We can’t stop or postpone a sale, negotiate your loan, or speak to your servicer for you. Paying the loan off or reinstating it stops a sale. A complete modification application sent in time, or a bankruptcy filing, can put a sale on hold, as the questions below explain.

Free help first

If you’d rather keep the house, call the HOPE™ Hotline at 888-995-HOPE (4673) before you call anyone else. It answers 24 hours a day, seven days a week, with HUD-approved housing counseling agencies (CFPB). HUD says its approved counselors help with foreclosure for free (HUD). Don’t pay anyone up front to save the house: federal rules generally bar mortgage relief companies from charging until you’ve signed the lender’s offer they got you (12 CFR §1015.5).

Questions people ask

Can I sell if the foreclosure sale is already scheduled?

Yes, until the sale happens. The closing has to pay off the loan before the first Tuesday, which is why we aim for several business days early.

How much time do I have after the notice of sale?

At least 21 days, counting the day the notice is given but not the day of the sale (§51.002(b), (g)). The notice states the earliest time the sale will start, and counties post filed notices on their websites (§51.002(f-1)).

Can I catch up instead of selling?

Often. On the standard Fannie Mae/Freddie Mac Texas deed of trust, you can reinstate until five days before the sale by paying what’s past due plus the costs of enforcing the loan (Form 3044, §20). Ask your servicer for a reinstatement quote and a payoff statement in writing today.

Does applying for a modification stop the sale?

A complete application that reaches the servicer more than 37 days before the sale generally stops it from selling until it has decided and any appeal is over (12 CFR §1024.41(g)). Small servicers are exempt from that part.

What if I owe more than the house is worth?

Then a sale can’t pay off the loan by itself, and the lender would have to agree to take less in a short sale. That’s the lender’s decision, on its timeline. The sheet shows the gap so you know before you call.

Can my HOA foreclose on my house?

Not for fines alone, or for attorney’s fees tied only to fines (Property Code §209.009). For unpaid assessments, an HOA has to get a court order before it can foreclose, unless you agree in writing, at the time it seeks foreclosure, to waive that step (§209.0092). The unpaid dues get paid from the sale at closing.

Does filing bankruptcy stop the sale?

Filing generally stops a foreclosure as soon as the petition is filed, though in some situations the stay lasts only a short time (U.S. Courts). Selling the house during the case generally takes notice and a hearing in the bankruptcy court (11 U.S.C. §363(b)), so talk to your bankruptcy attorney before you sign a contract with anyone.

Will you buy it while I’m still living there?

Yes. You pick the closing date, and you can stay up to 30 days after closing on a written leaseback.
